General Functions
   Prepares or complies memoranda for direct submission to Division or County Administration staff and Mayor's Office on complex or sensitive legal matters. Drafts ordinances, resolutions and administrative regulations. Provides legal counsel to County Administration staff and County Mayor's Office.
 
Representative Duties /Assignments
  
  • Prepares memoranda involving analysis, legal research, and application of thoroughly developed specialized legal expertise and transactional and/or litigation experience, as well as a thorough knowledge of County practices, procedures and policy objectives.
  • Drafts ordinances, resolutions, and administrative regulations. Documents are submitted directly to appropriate County staff at all levels unless extremely complex or sensitive matters are involved, in which case documents are reviewed by appropriate senior level staff. Drafting is accomplished after necessary legal research and technical policy development conferences with appropriate County staff, including the Mayor's Office. Drafting will require application of thoroughly developed specialized legal expertise in field of concern, thorough knowledge of County practices, procedures and policy objectives, and extensive familiarity with transactional matters encountered within the field subject to regulation.
  • Reviews and/or prepares transaction documents and negotiates transaction on behalf of County. Actions taken will be without direct supervision by senior legal staff unless matters involve substantial financial exposure to County or involve Board County policy ramifications. Transactions require the same cooperative effort, professional knowledge, and technical and/or transactional experience as regulatory drafting described above.
  • Provides office legal counsel and transaction negotiation services to Division and County Administration staff, and Mayor's Office through conferences, legal and/or transactional research, policy development efforts and participation in staff meetings and negotiations with senior management and administrators.
  • Litigates as lead counsel all but the most complex, sensitive, and highest financial exposure lawsuits, appellate proceedings and administrative appeals. Efforts involve preparation of pleadings, motions, interrogatories, investigations, extensive discovery proceedings, trial and appellate briefing, and cooperation with retained experts or counsel.
  • Participates in or supports, as directed, preparation and trial of complex, sensitive, and high financial exposure lawsuits under direction of senior legal staff. Efforts involve participation in appellate proceedings, if so directed by senior legal staff.
  • Coordinates and oversees all support provided by junior legal staff.
  • Recommends courses of action and/or settlement based on experience and professional judgment. Must accurately gauge probabilities of outcome of complex, sensitive, or high financial exposure litigation.
  • Undertakes and conducts settlement negotiations without direct supervision and subject to approval of only highest level County staff.
  • Attends as senior legal counsel, meetings of Advisory Boards, County and State regulatory agencies, and Board of County Commissioners. Provides legal advice and assistance in policy formulation and provides such incidental legal services as required incident to such attendance.
  • Reviews junior staff work product and professional performance. Provides sufficient counsel, advice and guidance to junior professional staff to insure continued professional development and thorough understanding of County policies, practices, and procedures, and the interrelationship of the County with other segments of the community.
  • Acts as Section Chief, when so designated, functioning as liaison between the County Attorney and junior professional and clerical staff. Oversees work assignments within Section and monitors for purposes of quality verification of professional work. Handles all but most complex or sensitive personnel and administrative problems occurring with Section.
  • Accepts administrative duties within the County Attorney's Office as delegated by County Attorney.
  • Directs secretarial and support staff in matters of County policy and practice, and monitors quality of work.
 
Minimum Qualifications
   Graduation from an accredited law school, possession of a Florida license to practice law and six years of experience as an attorney.
