A G R E E M E N T Granada Maintenance Corporation COMMON AREA MAINTENANCE THIS AGREEMENT  is entered by the Board of County Commissioners of ORANGE COUNTY, FLORIDA, a political subdivision of the State of Florida (hereinafter referred to as the "County")* and Granada Maintenance Corporation (hereinafter referred to as "GMC"), organized and existing under the laws of the State of Florida. W I T N E S S E T H WHEREAS, certain real property known as Granada Commons located in Orange County which is the entrance road area for that portion of the Granada Planned Development (which property shall hereinafter be referred to as "Granada Commons and Granada Boulevard") and identified in Exhibit "A"  of this agreement, has been platted as shown in the Public Records of Orange County, Florida, (hereinafter the "Property"); and is the entrance road area for the subdivisions listed in Exhibit "B"  of this agreement WHEREAS, the County finds that it is a valid County purpose under the laws of the State of Florida, to maintain the landscaping and beautification  of improvements installed within Granada Commons and Granada Boulevard as described, notated, and/or shown in Exhibit "C" of this agreement (hereinafter more particularly referred to as "Maintenance Area"), and WHEREAS, the Board of County Commissioners (hereinafter known as the "Board") has determined that a Municipal Service Taxing Unit now known as a Municipal Service Benefit Unit (hereinafter referred to as the "MSBU") for the purpose of generating revenue to provide for maintenance of the non-paved portions of road rights-of-wayand  areas over which Orange  County has a landscape easement now known as the Maintenance Areas will specially benefit the Granada Commons and Granada Boulevard area properties as well as benefiting the County as a whole. Therefore, the Board on June 3,1980, adopted a "Resolution Establishing The Granada Commons and Granada Boulevard Municipal Service Taxing Unit (MSTU) for Maintenance of Non-Paved Portions of Road Rights-of-Way and Areas Over Which Orange County Has a Landscape  Easement", as the most efficient and equitable means by which to finance such maintenance services, and WHEREAS, the County desires to contract with Granada Maintenance Corporation for such maintenance services for the benefit of the citizens of Orange County, and NOW, THEREFORE,THE PARTIES HERETO AGREE AS FOLLOWS: ARTICLE I- PURPOSE 1. The purpose of this Agreement is to provide for direct landscape maintenance costs, as defined in Article II, the maintenance area (or portions thereof) serving the developed phases of Bay Lakes at Granada and South Bay meeting the criteria of areas without improved above-ground structures that are: G:\Word\RMBS\Common\granadamain04 agr.doc 12
