General Functions |
|
Prepares or complies memoranda for direct submission to County staff at all levels, including the Chairman's Office and the Board of County Commissioners. Drafts ordinances, resolutions and administrative regulations. Serves as legal counsel in any lawsuit, appellate proceedings or administrative appeal. |

Representative Duties /Assignments |
|
- Prepares memoranda involving analysis, legal research, and application of thoroughly developed legal expertise and transactional and/or litigation experience, in area of subject matters and sufficient knowledge of County practices, procedures and policy objectives to accurately gauge impact on County fiscal status and policy objectives. Recommends appropriate course of action.
- Submits documents directly to all levels of appropriate staff, including the Board of County Commissioners. Drafting is accomplished after necessary legal research and review of same by junior staff and after technical and policy development conferences with County staff at all levels, including the County Chairman’s Office. If required, may include interested Commissioners and external managerial and administrative officials at any level. Drafting will require application of thoroughly developed specialized legal expertise in the field of concern, thorough knowledge of County practices, procedures and policy objectives, and a thorough familiarity with transactional matters encountered within the field involved. Drafting also will require judgment as to interplay of competing areas of interest and recommendations as to resolution of any conflicts arising from such competition.
- Reviews and/or prepares transaction documents and negotiates transactions on behalf of the County. Actions taken will be without supervision other than that of highest level County staff. Transactions require the same degree of cooperative effort, extent of professional knowledge, extent of policy and procedural knowledge, and technical and/or transactional experience as the regulatory drafting described above.
- Provides office legal counsel and transaction negotiation services to Division level, County Administration, and Chairman's staff, and when appropriate, Board of County Commissioners. Services are provided through conferences, legal and/or transactional research, policy development efforts and participation in meetings and negotiations (with or without additional County staff) with external management and administrators. Services will also include lobbying when so directed.
- Litigates as lead counsel in any lawsuit, appellate proceedings or administrative appeal and serves, as necessary, as coordinator of efforts of retained outside counsel and experts. Qualifies and recommends outside legal counsel and experts for retention, such as engineers, business damage analysts, economists, etc.
- Coordinates and oversees all support provided by junior legal staff.
- Recommends courses of action and/or settlement based on experience and professional judgment. Must accurately gauge probabilities of outcome of complex, sensitive, or high financial exposure litigation.
- Undertakes and conducts settlement negotiations without direct supervision and subject to approval of only highest level County staff.
- Attends as senior legal counsel, meetings of Advisory Boards, County and State regulatory agencies, and Board of County Commissioners to provide legal advice and assistance in policy formulation. Provides such incidental legal services as required incident to such attendance.
- Reviews junior staff work product and professional performance. Provides sufficient counsel, advice and guidance to junior professional staff to insure continued professional development and thorough understanding of County policies, practices, and procedures, and the interrelationship of the County with other segments of the community.
- Acts as Section Chief, when so designated, functioning as liaison between the County Attorney and junior professional and clerical staff. Oversees work assignments within Section and monitors for purposes of quality verification of professional work. Handles all but most complex or sensitive personnel and administrative problems occurring with Section.
- Accepts administrative duties within the County Attorney's Office as delegated by County Attorney.
- Directs secretarial and support staff in matters of County policy and practice, and monitors quality of work.
- Acts as surrogate County Attorney and performs any or all of the tasks assigned as responsibilities to the County Attorney. The role as surrogate overrides all other functions. Must be prepared to assume the role of County Attorney at any time, with little or no notice. Must maintain a level of operational intelligence and professional capacity closely akin to that of the County Attorney. Upon direction by County senior staff, the Deputy County Attorney will represent the County with authority equivalent to that of the County Attorney deal with community matters, or negotiate with members of the private sector and/or governmental entities.
- Performs tasks daily on the professional and institutional level of Attorney IV. Is customarily assigned as general counsel to operating divisions, which have high media exposure and are engaged in sensitive operations. These divisions frequently require "instantaneous" legal advise from an attorney who has gained a thorough knowledge of the Division's operations and mission. At present, the incumbent Deputy County Attorney acts as general counsel to the Corrections, Fire and Rescue, and Convention Center Departments.
- Performs any of the administrative functions of the County Attorney within the County Legal Department, as directed by the County Attorney. Examples of such duties are budget work-up and verifications, screenings and recommendation of applicants for professional employment, administrative and internal employment opportunities program, approval of vacation and term leave, decisions regarding purchasing and the implementation thereof, professional and task group work assignments, performance appraisal and evaluation of professional and staff personnel, and other similar matters.

Minimum Qualifications |
|
Graduation from an accredited law school, possession of a Florida license to practice law and eight years of experience as an attorney. |
